Please read these Terms of Service ("Terms") carefully before using Drummer's Metronome ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

Drummer's Metronome is a mobile application that provides metronome functionality with customizable beat patterns, drum sounds, and setlist management for musicians.

3. User Accounts

Some features require you to create an account using Sign in with Apple or Google Sign-In. You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Free and Pro Versions

The App is available in a free version with advertisements and a Pro version with additional features. The Pro version is available as a one-time in-app purchase.

• Purchases are processed through Apple App Store or Google Play Store
• Refunds are subject to the respective store's refund policy
• Pro features are tied to your store account and can be restored on new devices

5. User Content

You retain ownership of content you create (songs, setlists, patterns). By using cloud sync, you grant us a license to store and transmit this content solely to provide the service to you.

6. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems
• Use the App for any illegal purpose
• Interfere with other users' enjoyment of the App

7. Intellectual Property

The App, including its design, code, graphics, and audio samples, is protected by copyright and other intellectual property laws. You may not copy, modify, or distribute the App without our permission.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR MISSED PERFORMANCES.

10. Modifications to the App

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use after changes constitutes acceptance of the new Terms.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms shall be governed by the laws of Austria, without regard to conflict of law principles.
